THIS ACTIVITY WAIVER, RELEASE OF LIABILITY & MEDIA CONSENT FORM (the Waiver) is made and entered into on the 29/07/2026
IN CONSIDERATION of being permitted to participate in a Challenge Master competition, tournament, challenge, sporting event, endurance event, or other activity organized by The
Challenge Master (the "Activity Provider"), the undersigned participant (the "Participant") agrees as follows:
1. DETAILS OF ACTIVITY
The Participant will be participating in: (the "Activity"), which may involve physical exertion, endurance challenges, athletic competition, sporting contests, mental challenges, skill-based competitions, or other activities organized by the Activity Provider.
2. NO-PLAY REGISTRATION THRESHOLD &
CANCELLATION
The Participant acknowledges and agrees that certain Activities may be subject to a minimum registration threshold required for the event to be financially, operationally, and competitively viable.
If the required registration threshold is not achieved, the Activity Provider reserves the right to cancel, postpone, modify, or reschedule the Activity. In the event of a cancellation by the Activity Provider, the Participant's sole and exclusive remedy shall be a refund of the registration fee paid directly to the Activity Provider. The Activity Provider shall not be responsible for incidental or consequential expenses incurred by the Participant, including but not limited to transportation costs, accommodation expenses, meals, clothing, equipment purchases, loss of income, or any other personal expenses associated with participation.
3. ASSUMPTION OF RISK
The Participant acknowledges that participation in the Activity involves inherent and foreseeable
risks, including but not limited to:
Physical exertion and fatigue
Dehydration and heat-related illness
Muscle strains, sprains, cramps, and soreness
Falls, slips, trips, and collisions
Emotional stress and mental fatigue
Equipment malfunction or venue-related hazards
Injury, illness, disability, or death
The Participant fully understands these risks and voluntarily assumes responsibility for participating in the Activity.
The Participant acknowledges that not all risks can be anticipated or eliminated, despite reasonable safety precautions implemented by the Activity Provider.
4. FITNESS TO PARTICIPATE
The Participant represents and warrants that, to the best of their knowledge, they are physically and mentally capable of safely participating in the Activity. The Participant agrees to immediately discontinue participation and notify event officials if they experience symptoms including dizziness, chest pain, breathing difficulty, severe fatigue, loss of balance, or any other condition that may compromise their safety. The Participant understands that event officials and medical personnel may remove them from participation if continuing would create an unreasonable risk to their health or safety.
5. RELEASE OF LIABILITY
In consideration of being permitted to participate in the Activity, the Participant voluntarily releases, waives, discharges, and holds harmless the Activity Provider, its owners, directors, officers, employees, contractors, volunteers, sponsors, agents, affiliates, successors, and assigns from any claims, demands, actions, causes of action, damages, losses, liabilities, costs, or expenses arising out of or related to participation in the Activity, except where prohibited by
applicable law. This release applies to claims relating to personal injury, illness, property damage, economic loss, disability, or death arising from the inherent risks associated with participation in the
Activity.
6. COMPLIANCE WITH RULES & SAFETY INSTRUCTIONS
The Participant agrees to comply with all:
Official competition rules
Event policies
Safety procedures
Venue regulations
Instructions issued by judges
Instructions issued by event officials
Instructions issued by security personnel
Instructions issued by medical personnel
Failure to comply may result in disqualification, removal from the venue, suspension, or denial
of participation without refund.
7. MEDICAL AUTHORIZATION
The Participant authorizes the Activity Provider and its representatives to obtain emergency medical treatment if reasonably necessary. The Participant further authorizes emergency medical personnel to arrange transportation to an appropriate medical facility if deemed necessary. The Participant understands and agrees that all medical expenses, ambulance fees, hospital costs, medication costs, transportation expenses, and related charges shall remain the sole
responsibility of the Participant.
8. MEDIA RELEASE
The Participant grants to The Challenge Master an irrevocable, worldwide, royalty-free right and license to photograph, film, record, livestream, broadcast, reproduce, publish, distribute, display,
and otherwise use the Participant's name, voice, image, likeness, appearance, and performance in any media format now known or later developed. Such use may be for promotional, advertising, marketing, educational, editorial, commercial, or other lawful purposes without additional notice, approval, or compensation.
The Participant waives any right to inspect or approve the finished materials in which their likeness appears.
9. EVENT AUTHORITY & REMOVAL
The Activity Provider reserves the right to refuse participation, remove, suspend, disqualify, or deny entry to any participant whose conduct:
Violates event rules
Creates a safety concern
Threatens the welfare of participants or spectators
Disrupts the orderly operation of the Activity
Compromises the integrity of the competition
Such decisions shall be made in good faith and in accordance with event rules and safety requirements.
10. BINDING EFFECT
The Participant acknowledges that this Waiver shall be binding upon the Participant and their heirs, executors, administrators, personal representatives, successors, and assigns.
11. ELECTRONIC SIGNATURES
The Participant agrees that electronic acceptance of this Waiver, including checking an acknowledgment box during online registration, shall constitute a valid and legally binding electronic signature and shall have the same force and effect as a handwritten signature.
12. SEVERABILITY
If any provision of this Waiver is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
13. GOVERNING LAW
This Waiver shall be governed by and construed in accordance with the laws of Jamaica. The courts of Jamaica shall have exclusive jurisdiction over any dispute arising out of or relating
to this Waiver or the Participant's involvement in the Activity.
14. ACKNOWLEDGMENT
The Participant acknowledges and agrees that:
1. They have carefully read and fully understood this Waiver.
2. They have been given adequate opportunity to seek independent legal advice.
3. They understand the rights they are giving up by signing this Waiver.
4. They are signing this Waiver freely and voluntarily.
5. They intend for this Waiver to be legally binding.
